12월 1일 국가보안법 제정 62주년을 맞으며
12월 1일 국가보안법 제정 62주년을 맞아, 국제앰네스티는 국가보안법의 폐지, 혹은 근본적인 개정을 요구한다.
국 제앰네스티는 북한과 관련해 한국 내 안보 우려가 높다는 것을 이해한다. 하지만 안보 우려가 인권, 특히 의견을 평화롭게 표현할 권리를 부인하는 데 이용되어서는 안 된다. 국제앰네스티는 이러한 권리가 정부의 의견이나 정책에 반대하는 정치적 견해까지 포괄한다는 것을 한국 정부에 상기시키고자 한다.
국가보안법은 ‘반국가행위’, ‘이적행위’ 및 ‘간첩행위’를 금지하고 있으나 이를 구체적으로 정의하지 않고 있다. 국가보안법은 반대의견을 막고 평화적으로 표현 및 집회의 자유를 행사하는 이들을 임의적으로 기소하는데 지속적으로 이용되어왔다.
국가보안법은 검열이라는 형태로 북한을 ‘이롭게’ 한다고 간주되는 인쇄물을 출판 배포하는 이들을 처벌하는 데에도 이용되어왔다.
2010 년 8월 현재, 13명이 국가보안법 위반으로 구속되어 있으며 이들은 모두 친북활동에 관련되었다는 혐의로 체포되었다. 이들 중 최소 8명은 특히 한국이 당사국이며 법적구속력이 있는 시민적 및 정치적 권리에 관한 국제규약(ICCPR)과 같은 조약들을 비롯해 한국 헌법에 명시된 표현의 자유를 평화적으로 행사하던 중 체포되기도 했다.
국제앰네스티는 한국정부가 국제인권기준에 맞게 국가보안법을 근본적으로 개정하거나 완전히 폐지할 것을 요구한다.

NSL - SOLIDARITY STATEMENT ON 1 DECEMBER 2010
With 1 December marking the 62nd anniversary of the National Security Law (NSL), Amnesty International again calls for the NSL to be abolished or fundamentally reformed.
Amnesty International appreciates that South Korea has serious security concerns with regard to North Korea. However, security concerns should never be used to deny people the right to exercise their human rights, in particular the right to express their views peacefully. We would like to remind the government that this right extends to political views opposing the positions or policies of the government.
The NSL contains clauses that prohibit ‘anti-state’, ‘enemy-benefitting’ and ‘espionage’ activities but does not clearly define them. The law continues to be used as a tool to silence dissent and to arbitrarily prosecute individuals who are peacefully exercising their rights to freedom of expression and association.
The NSL has also been used as a form of censorship, to punish people for publishing and distributing material deemed to ‘benefit’ North Korea.
As of August 2010, 13 people were detained for violating the NSL, all of whom were charged with engaging in pro-North Korean activities. At least eight of the arrested individuals were peacefully exercising their right to freedom of expression, a right which is provided for in treaties that are legally binding on South Koreas, in particular the International Covenant on Civil and Political Rights (ICCPR), to which South Korea is a state party, as well as in South Korea’s constitution..
Amnesty International calls on South Korea to fundamentally reform the NSL to bring it into line with international human rights standards, or else to abolish it completely.
